Harbor implemented the Preferred Owner Program December 1st, 2009. The program is our way of saying "thank you" for being a loyal member of our automotive family. We value your business, and your friendship.

Being a Preferred Owner is NO COST to you. It is our way of rewarding our best customers. As a Preferred Owner, you earn Harbor Dollars on all Customer-Pay purchases in our Service, Parts and Body Shop departments. You can use your earnings on your next visit, or let them build.

Harbor’s Preferred Owner Program (hereinafter referred to as “the Program”) is open to all retail customers and employees of Harbor Automotive . (hereinafter referred to as “Harbor”). The purpose of the Preferred Owner program is to reward retail customers for doing business with Harbor.

Harbor reserves the right to modify this program, whether wholly or in part. Harbor also reserves the right to change the points awarded or to vary, at its own sole and absolute discretion, the terms and conditions stated herein, including withdrawing, replacing, and/or terminating the program at any time and without any prior notice to the Program card holder. Harbor Dollars have no cash value.

Program Summary

• One Point is equal to one Harbor dollar in purchasing power at a Harbor Automotive dealership
• Customers can review their account information and point balances at www.harborcars.com and clicking on the Preferred Owner link.
• Program members earn points for vehicle and service purchases at Harbor dealerships.
• Harbor Sales Dollars can be used for retail vehicle purchases at Harbor Automotive dealerships only.
• Harbor Service Dollars can be used for purchases of service and installed accessories at Harbor Automotive dealerships only.
• Harbor may conduct promotions during which customers may earn Extra Harbor Dollars.
• A valid e-mail address is not required, but strongly recommended to get the maximum benefit from the program.
• Preferred Card can be used for any vehicle in the accountholder’s household (four cards issued per account). Only one account per household.
• Harbor Dollars are earned on customer-paid purchases only. For example, points will not be awarded for warranty, insurance, or extended warranty service.
• Preferred Owners will also have the opportunity to earn Harbor Dollars at other leading online retailers by using the Points Plus link on www.harborcars.com  
• Each program member is responsible for ensuring that the information in his/her account is accurate and kept current.
• Harbor Service Dollars cannot be used toward the purchase of discounted oil changes.
• Items purchased with the preferred card cannot be returned for cash. All returned items’ value will be converted back into Harbor Dollars.
• Harbor Dollars cannot be redeemed for cash. Harbor Dollars have no cash value.
• Harbor Automotive reserves the right to suspend or discontinue the preferred owner program at any time at their sole discretion.
• The program is available to all Harbor customers who are over the age of 18 years old
• Fleet or wholesale customers are not eligible to participate in the program
• Participation in the program constitutes each Preferred Owner’s full and unconditional agreement to these Terms and Conditions.
• The personal information that is collected from each customer in connection with the program will be used in accordance with the GM Privacy Policy

This Harbor Preferred Owner Program supersedes all previously issued Harbor Preferred Owner/Reward programs. The offers set forth in the previous program are withdrawn and cancelled as of the start date of this program. The checkbook service discount checks can still be used, but all Repurchase/Referral Reward checks are hereby discontinued.

Modification and Termination of the Program

• Harbor may modify any of the terms and conditions governing the Program – including, but not limited to, the methods through which points can be earned, how the Program can be used, the value of the earned dollars, at any time, without notice, even though these changes may affect the Preferred Owner’s ability to use the points that have all ready been earned.
• The Program has no pre-determined termination date and may continue until such time that Harbor Automotive may terminate the program at any time, with no notice given.
• The Preferred Owners continued participation in the Program constitutes the Preferred Owners acceptance of any changes made to these Terms and Conditions. The Preferred Owners are responsible for remaining knowledgeable as to any changes that Harbor may make to these Terms and Conditions. The most current version will be available on the Preferred Owner’s Website and will supersede all previous versions of the Terms and Conditions.

General Terms and Conditions

• Accrued Harbor Dollars do not constitute property of a Preferred Owner and have no value outside of the program. Harbor Dollars are credits that Harbor Automotive may revoke at any time as set forth herein. Harbor Dollars may not be exchanged for cash, assigned, bartered, or transferred, except as set forth herein, and are not transferable upon death, as part of a domestic relations matter, or otherwise by operation of law.
• Each Preferred Owner is responsible for ensuring that the information in his/her account is accurate and kept current.

Limitation of Liability

• By participating in the Program, each Preferred Owner accepts all responsibility for, and hereby indemnifies and holds harmless Harbor Automotive and each of the their related companies, General Motors, Maritz , FMR and each such company’s respective officers, directors, employees, shareholders, agents, and successors, and assigns the “Released Parties”, from and against any claims that may arise from actions taken by such Member or for any unauthorized access to Preferred Owner’s account from a third party.
• UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM. EVEN IF ANY OR ALL OF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. IF A PREFERRED OWNER PROVES THAT HARBOR AUTOMOTIVE HAS IMPROPERLY DENIED THAT PREFERRED OWNER EARNED HARBOR DOLLARS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF EARNED DOLLARS. BY PARTICIPATING IN THE PROGRAM, A PREFERRED OWNER WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION, OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED. EACH PREFERRED OWNER SPECIFICALLY WAIVES ANY BENEFIT UNDER INDIANA LAW PRIVIDING A GENERAL RELEASE DOE S NOT EXTEND TO UNKNOWN CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN ITS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM WOULD HAVE MATERIALLY AFFECTED THE SETTLEMENT.

Legal Disputes.

• Preferred Owners agree that any controversy or claim at law or equity that arises out of or relates to the Program (“Claims”) shall be resolved in accordance with one of the subsections below, or as otherwise mutually agreed upon in writing by the parties.
  • Arbitration. For any Claim (excluding Claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000. Preferred Owners or Harbor Automotive may elect to resolve the dispute through binding arbitration conducted by telephone, online, and/or based solely upon written submissions where no-in person appearance is required. Any judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
  • Court. Alternatively, any Claim may be adjudicated by a court of competent jurisdiction located in Porter County, IN. Preferred Owners and Harbor Automotive agree to submit to the personal jurisdiction of the courts located within the county of Porter County, Indiana.
  • Violations of Section G (“Legal Disputes”) All Claims (excluding requests for injunctive or equitable relief) between the parties must be resolved using the dispute resolution mechanism that is selected in accordance with this Section by the party first to assert a Claim, either through a court filing or a commencement of arbitration. Should either party file an action contrary to this Section G, the other party may recover attorneys’ fees and costs up to $1000.00, provided that the party seeking the award has notified the other party in writing of the improperly filed Claim, and the other party has failed to withdraw the Claim.
• These Terms and Conditions are governed by and interpreted under the laws of the state of Indiana, U.S.; as such laws are applied to agreements entered into and to be performed entirely within Indiana by Indiana residents. Notwithstanding the foregoing sentence, the Federal Arbitration Act (“FAA”), and all of its rules and procedures, shall govern Section G hereof, to the extent that the FAA is inconsistent with Indiana law. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or the extent of such section. Harbor Automotive’s failure to act with respect to a breach by Preferred Owners does not waive its right to act with respect to subsequent or similar breaches. These Terms and Conditions and any documents it incorporates set forth the entire understanding between the parties with respect to the subject matter hereof. Sections F and G shall survive any termination or expiration of this agreement. It is the express wish of the parties that this document and any related documents be drawn up in English.
• If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in force.

Abuse of the Preferred Owner Program (including failure to follow program policies and procedures, the sale or barter of awards and any misrepresentation of fact relating thereto or other improper conduct, as determined by Dealer in its' sole judgment, any untoward or harassing behavior with reference to any Dealer employee or any refusal to honor Dealer employee's instructions) may result in cancellation of the member's account and future disqualification from program participation, forfeiture of all Harbor Dollars accrued. Dealer reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorney's fees and court costs.

Preferred Owner Program (POP)

When You Enroll You Receive a “POP” Card pre-loaded with rewards.

1. Each POP card is pre-loaded with Harbor Dollars
   • 150 Harbor Sales Dollars good for the purchase of a new or pre-driven vehicle.
   • 15 Harbor Service Dollars good for service, installed accessories, or body shop purchases.
2. $50.00 VSC Certificate towards the purchase of an Olympicare Extended Service Contract
3. Free Lube Oil Filter Rewards (Virtual Punch Card).
   • We electronically punch your card. When you purchase 5 Lube Oil Filter services, you earn the 6th one Free. After redeeming the Free service, a new punch card automatically begins

Earning Harbor Sales Dollars:

• 150 Harbor Sales Dollars when you purchase a new or pre-driven vehicle
• 150 Harbor Sales Dollars for a referral resulting in a new or used vehicle purchase

Earning Harbor Service Dollars:

• Earn 3% of every dollar spent on service, installed accessories, or body shop purchases converted to Harbor Service Dollars
• Earn 5% of every dollar spent on service, parts and accessories, or body shop purchases converted to Harbor Sales Dollars

Referring A Customer:

• Go to HarborCars.com and click on the “Refer A Customer” link.
  • Fill out the form listing your POP number and your referrals name and information
  • When they buy a vehicle, we add 150 Harbor Sales Dollars and 15 Harbor Service Dollars to your account

Earning “Points Plus” At Leading Retailers:

• You earn Harbor Dollars when you shop at leading online retailers like Best Buy, Ebay, Home Depot, Borders and more, by using the “Points Plus” link through your Preferred Owner account.

Redeeming Harbor Sales Dollars:

• Use toward the purchase of new or pre-driven vehicle from Harbor. $250.00 maximum redemption for a single purchase.

Redeeming Harbor Service Dollars:

• Use toward the purchase of service and installed accessories at a Harbor Service facility
• $20.00 minimum redemption amount, $250.00 maximum redemption amount
• Harbor Service Dollars cannot be used to purchase discounted Lube Oil Filter Services.
